1. Agreement to These Terms
These Terms of Service (“Terms”) apply when you visit or use TutorsLit websites, pages, applications, accounts, learning tips, lesson plans, videos, SAT practice materials, diagnostics, interactive HTML labs, embed tools, communications, and related products or services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and to the TutorsLit Privacy Policy.
If you use the Services for a school, district, business, organization, or other entity, you represent that you have authority to accept these Terms for that entity. A signed school, subscription, pilot, data-processing, purchase, or other written agreement may add to or replace portions of these Terms. If a signed agreement conflicts with these Terms, the signed agreement controls for that relationship.
2. Educational Purpose
TutorsLit provides educational content and tools intended to support teaching, tutoring, independent practice, and skill development in English language arts, financial literacy, SAT preparation, and related subjects. The Services do not replace a teacher, parent, tutor, school, qualified professional, individualized education program, accessibility plan, or professional judgment.
Learning outcomes depend on many factors outside TutorsLit’s control. TutorsLit does not guarantee any grade, academic result, test score, placement, admission decision, certification, financial outcome, or performance improvement.
3. Important Subject-Matter Limitations
Financial literacy content is educational only. It is not individualized financial, investment, tax, accounting, legal, insurance, credit, or lending advice. Examples, rates, rules, benefits, taxes, prices, and laws may change or may not apply to a particular user. Users should verify important information with current authoritative sources and consult an appropriately qualified professional before making financial or legal decisions.
SAT content is unofficial practice. TutorsLit diagnostics and labs do not reproduce the adaptive SAT, provide an official score, predict admission outcomes, or guarantee score improvement. SAT® is a trademark registered by the College Board. TutorsLit is not affiliated with or endorsed by the College Board.
Standards and classroom materials require educator review. References to Common Core, state standards, curriculum frameworks, lesson timing, grade bands, and instructional fit are provided as planning support. Educators remain responsible for confirming current requirements, suitability, accessibility, accuracy, and alignment for their learners and jurisdiction.
4. Eligibility and Student Use
The Services may be used by adults, educators, parents, schools, organizations, and students. A minor may use the Services only with the permission and supervision required by applicable law, school policy, and the responsible parent, guardian, teacher, or school.
Do not direct a child under 13 to create an account or submit personal information unless TutorsLit has approved the deployment and the school or parent has completed any required authorization or consent process. Schools and other organizations are responsible for determining that their use of the Services is permitted under applicable student-privacy laws and policies.
5. Accounts and Access
Some Services require an account, login, subscription, invitation, or session token. You must provide accurate information, keep credentials and access links confidential, and promptly notify TutorsLit if you suspect unauthorized access. You are responsible for activity through your account or credentials except to the extent caused by TutorsLit.
You may not share an individual account beyond its authorized users, attempt to access another user’s records, or use bearer tokens, report links, administrative pages, or other access methods outside their intended purpose.
6. Interactive Labs, Lesson Plans, and LMS Embeds
TutorsLit may provide working HTML activities, lesson plans, links, or embed code for use in a learning management system (“LMS”), school website, classroom page, or other authorized educational environment. Subject to these Terms, TutorsLit grants educators and authorized organizations a limited, nonexclusive, nontransferable, revocable license to display the provided resource for their own educational use.
You may not remove ownership notices or branding, alter an embed to misrepresent its source, sell or sublicense the resource, use it in a misleading or unlawful context, extract question banks or source code for a competing product, or circumvent access or security controls. Ordinary LMS configuration, responsive sizing, and accessibility accommodations that do not change the instructional substance are permitted.
Embedded resources may communicate technical or completion information to the parent page or LMS when that functionality is implemented. The LMS operator is responsible for its own privacy notice, permissions, security, data handling, and compliance. TutorsLit does not guarantee compatibility with every LMS, browser, device, content-security policy, or future platform update.
7. User Content and Student Work
Users may submit responses, writing, recordings, answers, comments, files, annotations, or other materials (“User Content”). You retain ownership of User Content subject to rights held by your school, organization, or another party.
You give TutorsLit a limited right to host, process, display, transmit, store, analyze, and use User Content as reasonably necessary to provide, secure, support, maintain, and improve the Services and to meet contractual or legal obligations. This permission does not give TutorsLit ownership of User Content. You are responsible for having the rights and permissions needed to submit it.
Do not submit Social Security numbers, financial-account credentials, medical records, highly sensitive personal information, or confidential information that the applicable TutorsLit service has not expressly requested and authorized.
8. AI-Assisted Features
Some Services use artificial intelligence or automation to generate feedback, summaries, recommendations, classifications, practice materials, speech, video, or other support. AI output may be incomplete, incorrect, outdated, biased, or unsuitable for a particular learner or situation.
AI output must be reviewed by a responsible human before it is used for grading, placement, discipline, eligibility, financial decisions, legal decisions, or another significant decision. TutorsLit AI features are instructional aids and should not be the sole basis for a high-impact decision.
9. Acceptable Use
You may not:
- use the Services for unlawful, harmful, abusive, harassing, discriminatory, deceptive, or privacy-invasive activity;
- upload malware, harmful code, spam, infringing material, or content that violates another person’s rights;
- scrape, crawl, reverse engineer, probe, overload, disable, or bypass security or access controls except where applicable law expressly permits;
- copy, publish, redistribute, resell, or commercially exploit TutorsLit content except through an expressly provided sharing or embed function or written permission;
- use the Services to build, train, benchmark, or improve a competing dataset, model, assessment, courseware product, or commercial service without written permission;
- collect information about students or other users without appropriate authority and notice; or
- impersonate another person or misrepresent an affiliation, endorsement, result, or source.
10. TutorsLit Content and Intellectual Property
The Services—including lessons, learning tips, videos, question banks, diagnostics, labs, software, designs, text, graphics, names, logos, interfaces, and reports—are owned by TutorsLit or its licensors and are protected by intellectual-property and other laws.
Except for the limited educational and embed rights expressly granted in these Terms or a signed agreement, no right or license is granted. Feedback or suggestions you voluntarily provide may be used by TutorsLit without restriction or compensation, provided TutorsLit does not publicly identify you without permission.
11. Third-Party Services and Links
The Services may link to or integrate with LMS platforms, video hosts, analytics providers, AI providers, content-delivery networks, government resources, social platforms, app stores, and other third parties. TutorsLit does not control and is not responsible for third-party content, security, availability, accessibility, terms, or privacy practices.
A link or reference does not necessarily mean TutorsLit endorses the third party or guarantees the accuracy of its information. Your use of third-party services is governed by their own terms and policies.
12. Privacy
The TutorsLit Privacy Policy explains the categories of information TutorsLit collects, how that information is used and disclosed, student-privacy practices, cookies and browser storage, AI processing, retention, and available choices. Additional school agreements or service-specific notices may apply.
13. Fees and Separate Agreements
Some Services are free. Others may require a subscription, pilot agreement, purchase order, school agreement, or other arrangement. Pricing, billing, renewal, cancellation, and refund terms will be provided separately when applicable.
14. Availability, Updates, and Technical Requirements
TutorsLit may add, modify, correct, suspend, discontinue, or limit any Service, feature, resource, question, link, lab, embed method, or access method. The Services may be unavailable because of maintenance, outages, hosting failures, third-party changes, security events, browser restrictions, or other causes.
You are responsible for maintaining compatible equipment, internet access, browser settings, LMS permissions, backups, and security appropriate for your use.
15. Accuracy, Mistakes, and Reliance
TutorsLit works to provide useful and accurate materials, but the Services may contain factual errors, calculation errors, typographical errors, omissions, outdated information, broken links, coding defects, incomplete explanations, incorrect classifications, or content that does not fit a particular learner, course, standard, law, or situation.
You are responsible for reviewing and independently verifying information before relying on it for instruction, assessment, financial choices, legal compliance, school policy, student placement, or another important decision. Your use of and reliance on the Services is at your own risk. TutorsLit has no duty to update any particular item immediately, but may correct or remove content at any time.
16. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TUTORSLIT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, AVAILABILITY, COMPATIBILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
TutorsLit does not warrant that the Services will meet every legal, curricular, accessibility, technical, privacy, or security requirement applicable to a user, school, LMS, or jurisdiction.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TUTORSLIT AND ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, PARTNERS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, OPPORTUNITY, OR GOODWILL; BUSINESS OR CLASSROOM INTERRUPTION; ACADEMIC, TESTING, ADMISSION, FINANCIAL, OR PROFESSIONAL OUTCOMES; OR LOSSES ARISING FROM ERRORS, OMISSIONS, RELIANCE, THIRD-PARTY SERVICES, UNAUTHORIZED ACCESS, OR SERVICE UNAVAILABILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF TUTORSLIT FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID TO TUTORSLIT FOR THE AFFECTED SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100.
These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply. Nothing in these Terms excludes liability that cannot lawfully be excluded.
18. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold TutorsLit harmless from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your misuse of the Services, violation of these Terms, infringement of another person’s rights, unlawful handling of student or personal information, unauthorized modification or distribution of content, or User Content you submit. This section does not apply to the extent a claim was caused by TutorsLit’s own unlawful conduct.
19. Suspension and Termination
TutorsLit may suspend or terminate access when it reasonably believes a user has violated these Terms, created security or legal risk, infringed rights, failed to pay amounts due, or used the Services in a way that may harm TutorsLit, users, systems, schools, or partners. Upon termination, rights granted under these Terms end, but provisions that by their nature should survive will survive.
20. Governing Law and Venue
Unless a signed agreement states otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not resolved informally must be brought in a state or federal court with jurisdiction in Sonoma County, California, and each party consents to that venue, except where applicable law does not permit this choice.
21. General Terms
If a provision of these Terms is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without TutorsLit’s written consent; TutorsLit may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. Headings are for convenience only.
22. Changes to These Terms
TutorsLit may update these Terms as the Services or laws change. The effective date will be updated, and material changes may also be communicated through the Services or by another reasonable method. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.
